Consumer Right of Withdrawal

This notice applies to Consumers entering into a distance contract with Cinemura. Cancellation and withdrawal are different declarations: cancellation ends a subscription for the future; timely withdrawal produces the statutory reversal consequences.

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the contract is entered into.

of your decision to withdraw by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form in Section 5, but you are not required to do so.

You may also exercise your right online at 【AUSFÜLLEN: dauerhaft erreichbare URL der Widerrufsfunktion】. If you use this online function, we will send you, without undue delay and on a durable medium such as email, an acknowledgement containing the content of your withdrawal statement and the date and time it was received.

To meet the deadline, it is sufficient for you to send the statement exercising your right before the withdrawal period expires.

2. Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive your withdrawal statement. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise; in no event will you incur fees as a result of the reimbursement.

If you expressly requested that we begin supplying a service before the withdrawal period expires, you must pay us a reasonable amount corresponding to the proportion of the conforming service supplied up to the time you tell us that you are withdrawing, compared with the full coverage of the contract. This applies only if we duly informed you about the right of withdrawal and the obligation to pay that amount. No amount is payable for digital content not supplied on a tangible medium when the relevant contract is withdrawn.

The statutory reversal consequences for digital products, including Section 327p BGB, also apply. Following withdrawal, you must not continue to use or make supplied digital content available to third parties to the extent provided by law.

3. Beginning performance during the withdrawal period

A request for immediate access is voluntary. Where Cinemura is to begin supplying a service before the withdrawal period expires, a separate express declaration will be obtained before performance begins. General acceptance of the Terms is not sufficient.

Activating an ongoing subscription or first use does not by itself cause the right of withdrawal to expire. Under Section 356(5) BGB, the right in relation to a paid service expires early only upon full performance if, before performance begins, you expressly consented to the early start and acknowledged that you understand that your right expires upon full performance.

4. Early expiry for digital content

For a separate contract concerning digital content not supplied on a tangible medium, the right may expire under Section 356(6) BGB when performance begins only if all of the following conditions are met:

1. Cinemura has begun performance;
2. you expressly consented to Cinemura beginning before the withdrawal period expires;
3. you acknowledged that you understand that, by giving that consent, you lose your right when performance begins; and
4. Cinemura provided a contract confirmation on a durable medium under Section 312f BGB recording that consent and acknowledgement.

6. Technical and contractual prerequisites before publication
